Emitly Terms of Service
These Terms of Service ("Terms") are a legal agreement between you and Evergreen Court Ventures LLC ("Evergreen Court Ventures," "we," "us," or "our"), the company that operates the Emitly mobile app ("Emitly" or the "App"). They govern your access to and use of the App.
Please read them carefully. By creating an account or using Emitly, you agree to these Terms. If you do not agree, do not use the App.
1. Who can use Emitly
You must be at least 18 years old to use Emitly. By creating an account or using the App, you confirm that you are 18 or older and able to enter into this agreement.
Emitly is intended for adults. It is not directed to children or teenagers, and we do not knowingly allow anyone under 18 to create an account.
2. Your account
To use Emitly, you create an account using your email address, Sign in with Apple, or Sign in with Google. You agree to provide accurate information and to keep your login credentials secure. You are responsible for activity that happens under your account.
If you believe your account has been accessed without your permission, contact us at hello@emitlyapp.com.
You can delete your account and its data at any time from within the App, under Settings.
3. License to use the App
Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to download and use Emitly on devices you own or control, for your own personal, non-commercial use.
You agree not to:
- Copy, modify, distribute, sell, or lease any part of the App;
- Reverse engineer or attempt to extract the source code, except where the law expressly permits it;
- Use the App to break any law or to infringe anyone's rights;
- Interfere with or disrupt the App, its servers, or its security; or
- Access the App through automated means, or attempt to circumvent usage limits, subscription gates, or rate limits.
4. Plans, free trial, and subscriptions
Emitly offers a free plan, a limited-time free trial, and a paid subscription (Emitly Premium).
4.1 Free trial (14 days)
New users receive a 14-day free trial. During the trial you can keep up to three active statements and read the free Learn articles. The AI refinement tool and Premium Learn content are not included in the trial.
The trial is provided directly by Emitly. It does not require a payment method, and it does not automatically convert into a paid subscription. When the 14 days end, if you have not chosen to subscribe, your account simply moves to the free plan described below. You will not be charged.
4.2 Free plan
After the trial, and any time you are not subscribed, you can continue using Emitly on the free plan at no cost. The free plan includes one active statement, along with reminders, alignment check-ins, streak tracking, and the free Learn articles.
If you have more than one statement when your account moves to the free plan, your additional statements are archived, not deleted. Archived statements remain readable and are preserved on your account, but they do not send reminders and do not count as your active statement. You can choose which statement is active. Subscribing to Premium restores up to three active statements.
4.3 Emitly Premium
Emitly Premium unlocks up to three active statements, the full Learn library (including Premium content), and the AI statement refinement tool.
Premium is offered as a monthly or annual subscription. The current pricing is $5.99 per month or $47.99 per year. Prices may vary by country and currency, and the exact price and billing period are always shown in the App before you confirm a purchase.
4.4 Billing, renewal, and cancellation
Emitly Premium is sold as an auto-renewable subscription and is processed by the Apple App Store or Google Play, not by us directly. When you subscribe:
- Payment is charged to your App Store or Google Play account when you confirm the purchase.
- Your subscription renews automatically for the same period at the then-current price, unless you cancel it at least 24 hours before the end of the current period.
- Your store account is charged for renewal within 24 hours before the current period ends.
- You can manage or cancel your subscription at any time in your App Store or Google Play account settings. Cancellation takes effect at the end of the current billing period, and you keep Premium access until then. After that, your account moves to the free plan.
We do not store your payment card details. Billing is handled entirely by Apple or Google under their terms.
4.5 Refunds
Purchases are processed by the Apple App Store or Google Play, and refunds are subject to each store's process:
- Apple App Store: We are not able to issue App Store refunds directly. Apple reviews and decides all refund requests. To request one, use Apple's process at reportaproblem.apple.com or your purchase history in the App Store.
- Google Play: You can request a refund through Google Play, or contact us at hello@emitlyapp.com and we will review your request and issue a refund where we consider it appropriate.
Nothing in these Terms limits any non-waivable refund or cancellation rights you may have under the consumer laws of your country.
4.6 Price changes
We may change subscription prices from time to time. Any change will apply to future billing periods, and where required by the app stores or by law, you will be notified and given the chance to accept the new price or cancel before it takes effect.
5. AI statement refinement
Emitly Premium includes an optional AI tool that helps you refine your manifestation statements. A few things to understand about it:
- The tool uses a third-party AI model to generate suggestions based on the text you provide. It requires an internet connection and an active subscription, and it is subject to a daily usage limit.
- AI-generated suggestions are just that: suggestions. They may not always be accurate, appropriate, or exactly what you intended. You can accept, edit, or discard them, and you are responsible for the statements you choose to keep and use.
- The AI tool is provided for personal reflection and intention-setting. It does not provide medical, psychological, financial, legal, or other professional advice.

6. Your content
Your manifestation statements, check-ins, and other content you create in Emitly belong to you. We do not claim ownership of them.
To operate the App, you grant us a limited license to store, process, sync, and back up your content for the purpose of providing Emitly's features to you (for example, syncing your statements across your devices and restoring them after a reinstall). This license exists only to run the service and ends when you delete the content or your account, subject to routine backups as described in the Privacy Policy.
You are responsible for the content you create, and you agree not to use Emitly to store or create content that is unlawful or that infringes the rights of others.
7. Our intellectual property
Emitly, including its name, logo, design, software, and all Learn tab content, is owned by Evergreen Court Ventures LLC and its licensors, and is protected by intellectual property laws. The Emitly name and brand are our trademarks. The Learn content is authored under the name Aurelia Valo and may not be copied, republished, or redistributed without our permission.
These Terms do not grant you any right to use our name, brand, or content except as needed to use the App as intended.
8. Disclaimers
Emitly is a tool for personal reflection, intention-setting, and habit-building. It is provided for self-improvement purposes only.
We make no promise or guarantee that using Emitly will produce any particular result, outcome, financial gain, income, improvement in health or wellbeing, or change in your life circumstances. Manifestation practices are personal, and individual experiences vary widely. Any examples or statements in the App describing what is possible are illustrations, not promises of results.
Nothing in Emitly is medical, psychological, financial, legal, or other professional advice, and it is not a substitute for care from a qualified professional. If you are dealing with a health, mental health, financial, or legal matter, please consult an appropriate professional.
The App is provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. We do not warrant that the App will be uninterrupted, error-free, or secure, or that reminders will always be delivered at the exact time scheduled.
9. Limitation of liability
To the fullest extent permitted by law, Evergreen Court Ventures LLC and its owners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or relating to your use of (or inability to use) Emitly.
To the fullest extent permitted by law, our total liability for any claim relating to the App will not exceed the greater of the amount you paid us for Emitly in the twelve months before the claim, or twenty U.S. dollars ($20).
Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited under applicable law.
10. Indemnification
You agree to indemnify and hold harmless Evergreen Court Ventures LLC and its owners from any claims, damages, losses, and expenses (including reasonable legal fees) arising out of your misuse of the App, your violation of these Terms, or your violation of any law or the rights of another.
11. Suspension and termination
You may stop using Emitly at any time and delete your account from Settings.
We may suspend or terminate your access to the App if you violate these Terms, misuse the App, or create risk or legal exposure for us. Where reasonable, we will try to give you notice. If your account is terminated, the license granted in these Terms ends, though sections that by their nature should survive (such as intellectual property, disclaimers, limitation of liability, and governing law) will continue to apply.
12. Changes to the App and to these Terms
We may update, change, or discontinue features of the App over time. We may also update these Terms. When we make material changes, we will update the "Last updated" date above and, where appropriate, provide a more prominent notice in the App. Your continued use of Emitly after changes take effect means you accept the updated Terms. If you do not agree to a change, please stop using the App and, if you wish, delete your account.
13. Governing law and disputes
These Terms are governed by the laws of the State of Utah, without regard to its conflict-of-laws rules. Subject to any non-waivable rights you have under the laws of your own country or state, you agree that the state and federal courts located in Utah will have exclusive jurisdiction over any dispute that is not otherwise resolved.
Before filing any formal claim, you agree to first contact us at hello@emitlyapp.com so we can try to resolve the matter informally. Most concerns can be sorted out this way.
14. App Store and Google Play terms
You may download Emitly from the Apple App Store or Google Play. The following additional terms apply, and are intended to satisfy Apple's requirements for licensed applications:
- This agreement is between you and Evergreen Court Ventures LLC only, and not with Apple or Google. We, not Apple or Google, are solely responsible for the App and its content.
- Apple and Google have no obligation to provide any maintenance or support for the App.
- To the maximum extent permitted by law, Apple and Google have no warranty obligation with respect to the App. Any claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to any warranty are our responsibility.
- We, not Apple or Google, are responsible for addressing any claims relating to the App, including product liability claims, claims that the App fails to conform to legal or regulatory requirements, and claims arising under consumer protection or similar law.
- If a third party claims the App infringes their intellectual property, we, not Apple or Google, are responsible for the investigation, defense, settlement, and discharge of that claim to the extent required by these Terms.
- You represent that you are not located in a country subject to a U.S. Government embargo, and that you are not on any U.S. Government restricted-party list.
- Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple will have the right to enforce them against you.
- Your use of the App must also comply with the applicable App Store or Google Play terms of service.
