Emitly Privacy Policy

1. Who we are

Emitly is operated by Evergreen Court Ventures LLC, a limited liability company organized in the State of Utah, United States. For the purposes of the EU and UK General Data Protection Regulation (GDPR), Evergreen Court Ventures LLC is the "data controller" of your personal information.

2. Information we collect

We collect only what we need to run the App. This falls into a few categories.

2.1 Account information

When you create an account, we collect your email address and, optionally, a display name. Depending on how you sign in:

  • Email and password: we collect your email address. Your password is handled by our authentication provider (Supabase) and is stored only in a hashed form. We never see or store your plaintext password.
  • Sign in with Apple: Apple provides us with a name (if you choose to share it) and either your email address or a private relay email address (for example, something@privaterelay.appleid.com). Relay addresses forward to your real inbox without revealing it to us.
  • Sign in with Google: Google provides us with your email address and basic profile information you have authorized.

2.2 Content you create

Emitly stores the content you enter so it is available across your devices and after a reinstall:

  • Your manifestation statements (titles and body text)
  • Your reminder schedules (times and settings)
  • Your alignment check-in responses (a 1–5 score)
  • Your streak data (current streak, best streak, and last check-in date)

This content is private to your account. We do not read it for any purpose other than operating the features you use, and we do not use it for advertising or profiling.

2.3 Subscription and purchase information

If you subscribe to Emitly Premium, your purchase is processed by the Apple App Store or Google Play, and your subscription status is managed through our subscriptions provider (RevenueCat). We receive your subscription status and purchase events (such as when a subscription starts, renews, or lapses).

We never receive or store your payment card number or billing details. Those are handled entirely by Apple or Google under their own privacy policies.

2.4 AI refinement inputs

Emitly Premium includes an optional AI refinement tool. When you use it, the text you submit (your rough intention and your answers to the tool's questions) is sent to our AI provider (Anthropic) to generate a refined statement and return it to you. See Section 6 for details on how this works and what is and is not shared.

2.5 Device and technical information

To keep the App working reliably, we collect limited technical information:

  • A push notification token, so we can deliver your reminders. (Reminders are scheduled on your device; the token allows the notification system to function.)
  • Crash and error diagnostics, including device type, operating system version, app version, and technical details about an error when the App crashes. This is provided through Expo's built-in crash reporting and is used only to diagnose and fix problems.

Emitly does not include third-party advertising SDKs, and we do not track you across other apps or websites.

3. How we use your information

We use the information above to:

  • Provide the App's core features — storing and syncing your statements, scheduling reminders, and tracking check-ins and streaks;
  • Create and manage your account and authenticate you when you sign in;
  • Manage your subscription and unlock Premium features;
  • Deliver push notifications you have enabled (your reminders);
  • Send you transactional emails, such as a welcome message and a subscription confirmation (we do not send marketing emails to addresses collected at signup);
  • Provide the AI refinement feature when you choose to use it;
  • Diagnose crashes, fix bugs, and improve the reliability and performance of the App;
  • Protect the security and integrity of the App and enforce our Terms of Service; and
  • Comply with our legal obligations.

4. Legal bases for processing (EEA and UK users)

If you are in the European Economic Area or the United Kingdom, we rely on the following legal bases under the GDPR:

  • Performance of a contract: to provide the App and its features to you, manage your account, and process your subscription.
  • Legitimate interests: to keep the App secure, diagnose crashes, and improve our service, in a way that does not override your rights.
  • Consent: where you have given it — for example, to send push notifications, or when you choose to submit text to the AI refinement tool. You may withdraw consent at any time.
  • Legal obligation: where we must process information to comply with the law.

5. How your information is shared

We do not sell your personal information, and we do not share it for advertising or cross-context behavioral advertising.

We share information only with the service providers ("sub-processors") that help us operate the App, and only to the extent needed to provide their service to us:

Each of these providers is bound by its own privacy commitments and processes your information on our behalf.

We may also disclose information if required to do so by law, or to protect the rights, safety, and property of our users, the public, or us — for example, in response to a valid legal request. If we are ever involved in a merger, acquisition, or sale of assets, your information may be transferred as part of that transaction, and we will notify you of any change in ownership or use of your personal information.

6. AI features and your data

The AI refinement tool is optional and only runs when you actively use it. Here is how your data is handled:

  • The text you enter is sent from your device to our server function, which forwards it to Anthropic to generate a refined statement.
  • The request we forward to Anthropic contains only your refinement text, not your name, email, or account identifiers.
  • Under Anthropic's commercial API terms, the inputs we send are used to generate your result and are not used to train Anthropic's models.
  • We do not use the content of your statements or refinement requests to build advertising or marketing profiles.

7. Data retention

We keep your personal information for as long as your account is active or as needed to provide the App.

When you delete your account (see Section 8), we delete your associated data from our systems, including your statements, reminders, check-ins, and streaks. Copies may remain in routine backups for a limited period before being overwritten, and we may retain limited information where we are legally required to do so.

Records of your purchases and subscription are also retained by Apple, Google, and RevenueCat under their own retention policies and applicable law, independent of your Emitly account.

8. Your rights and choices

8.1 Delete your account and data

You can delete your account and all associated data at any time from within the App, under Settings. This permanently removes your statements, reminders, check-ins, and streaks from our systems and cancels the association with your subscription. If you subscribed through Apple or Google, remember to also cancel the subscription in your App Store or Google Play account so you are not billed again.

8.2 EEA and UK rights (GDPR)

If you are in the EEA or UK, you have the right to:

  • Access the personal information we hold about you;
  • Correct inaccurate information;
  • Delete your information ("right to erasure");
  • Restrict or object to certain processing;
  • Data portability — receive your information in a portable format;
  • Withdraw consent at any time, where processing is based on consent; and
  • Lodge a complaint with your local data protection authority.

8.3 California rights (CCPA/CPRA)

If you are a California resident, you have the right to know what personal information we collect, to request access to or deletion of it, to correct it, and to not be discriminated against for exercising these rights. We do not sell or share your personal information as those terms are defined under the CCPA/CPRA, and we do not process it for cross-context behavioral advertising.

8.4 How to exercise your rights

For most requests, the fastest route is the in-app delete option in Settings. For any other request, email us at hello@emitlyapp.com and we will respond within the timeframe required by applicable law. We may need to verify your identity before acting on a request.

8.5 Notification and communication choices

You can turn reminders and other push notifications on or off in the App or in your device settings. Transactional emails related to your account and subscription are a necessary part of the service and are not marketing.

9. International data transfers

We are based in the United States, and your information is processed in the United States and in other countries where our service providers operate. If you are located outside the United States, you understand that your information will be transferred to and processed in the United States. Where required, transfers of personal information out of the EEA or UK are protected by appropriate safeguards, such as the Standard Contractual Clauses used by our service providers.

10. Children's privacy

Emitly is intended for adults. You must be 18 or older to use the App, and it is not directed to children or teenagers. We do not knowingly collect personal information from anyone under 18. If you believe someone under 18 has provided us with personal information, please contact us at hello@emitlyapp.com and we will delete it.

11. Data security

We take reasonable measures to protect your information, including encryption of data in transit (HTTPS), database access controls that restrict each user to their own data, and keeping sensitive credentials (such as our AI provider's API key) on the server and never in the App. No method of transmission or storage is completely secure, so we cannot guarantee absolute security, but we work to protect your information and to respond promptly to any issue.

12. Our website (emitlyapp.com)

Our website at emitlyapp.com is an informational site where you can learn about Emitly and find links to download the App. You can browse it without creating an account or giving us any personal details.

Information collected automatically. As with most websites, when you visit emitlyapp.com our hosting provider (Cloudflare) records standard technical information in server logs, such as your IP address, browser type, device and operating system, the page that referred you, and the date and time of your visit. We use this to keep the site running, protect it against abuse, and understand general traffic patterns. We do not use it to identify you personally.

Cookies and tracking. Our website is a simple informational site. It does not set advertising cookies, and we do not use third-party ad networks or cross-site tracking on it.

The rest of this Privacy Policy also applies to information collected through the website, including your rights (Section 8), international transfers (Section 9), and how to contact us (Section 14).

13. Changes to this policy

We may update this Privacy Policy from time to time. When we do, we will revise the "Last updated" date at the top and, where the changes are significant, provide a more prominent notice within the App. Your continued use of Emitly after an update means you accept the revised policy.
